The owner of the online store hoia.bio (hereinafter WebShop) is HTM Karolin OÜ (registry code 12619762), with a jurili address Loo 1, Kudjape, Lääne-Saare parish, Saare mk.
1. Validity of sales contract, item and price information
1.1 The terms of sale apply to the purchase of goods from the Online Store.
1.2 The prices of the products sold in the online store are indicated next to the products. The price is accompanied by a fee for the delivery of the goods, except for promotions, during which the goods are delivered free of charge.
1.3 The delivery fee depends on the location of the buyer and the manner of delivery. The delivery fee is displayed to the buyer when placing an order.
1.4 Orders exceeding EUR 40 will be delivered free of charge.
1.5 Information about the goods is presented in the Online Store right next to the goods.
2. Placing an order
2.1 In order to order the goods, you need to add the desired products to the shopping cart. In order to place an order, you must fill in the required data fields and choose the appropriate method of delivery of products. The amount of the fee will then be displayed on the screen, which can be paid via a bank link.
2.2 The goods can be paid for through the Pocopay payment solution and through the bank links of the following banks:
Swedbank, SEB, LHV, Krediidipank, Nordea, Danske
2.3 The agreement enters into force as of the receipt of the amount due to the current account of the Online Store.
2.4 If the ordered goods cannot be delivered due to the end of the goods or for any other reason, the buyer will be notified as soon as possible and the money paid (including the cost of delivery of the goods) will be refunded immediately, but not later than within 14 days of the notification being sent.
3.1 Goods are shipped within Estonia.
3.2 The purchaser shall bear the shipping costs of the goods if the order amount is less than 40 euros and the corresponding price information is displayed in the shipping method.
3.3 Orders will be posted within 1-3 working days. If possible, the goods will be shipped the same day or the next day. If you are in a hurry to receive the goods, you can always write it in additional information and, if possible, the parcel will be sent out of the Online Store faster.
3.4 Shipments within Estonia generally reach the destination specified by the buyer within 1-5 working days from the entry into force of the sales contract. In exceptional cases, the goods have the right to be delivered within 7 calendar days.
3.5 IT is not possible to order HOIA products to foreign countries via the online store, if you wish to order products abroad, please write email@example.com about your wish.
4. Right of withdrawal
4.1. After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days.
4.2. The right of withdrawal does not apply if the buyer is a legal person.
4.3 In order to exercise the 14-day right of return, the ordered goods may not be used in any other way than is necessary to ascertain the nature, characteristics and functioning of the goods in the manner permitted for examination.
4.4 The right of withdrawal cannot be exercised if the consumer has already used, fingered or opened the packaging in a way that can no longer be offered to third parties for health or hygienic reasons.
4.5 In order to return the goods, the request to withdraw must be notified of the request to withdraw by the e-mail firstname.lastname@example.org within 14 days of receipt of the goods at the latest.
4.6 The purchaser shall bear the cost of returning the goods, unless the reason for the return lies in the fact that the item to be returned does not comply with the order (e.g. a wrong or defective item).
4.7 The Buyer must return the goods within 14 days after submitting the application or provide proof that they have delivered the goods to the carrier within the aforementioned period.
4.8 Upon receipt of the returned goods, the Online Store shall immediately, but not later than 14 days after receipt of the withdrawal application, return to the Buyer all fees received from the Buyer on the basis of the contract.
4.9 The online store may refuse to make refunds until they have recovered the item subject to the contract or until the buyer has provided evidence that they have returned the item, whichever comes first.
4.10 If the Buyer has expressly chosen a different method of delivery from the cheapest standard delivery method offered by the Online Store, the Online Store does not have to refund to the consumer a cost that exceeds the cost related to the usual delivery method.
4.11 The online store has the right to withdraw from the sales transaction and demand the goods back from the buyer if the price of the goods in the online store is marked significantly below the market price of the goods due to an error.
5. Right to file a complaint
5.1 The online store is responsible for the non-conformity or defect of the goods sold to the buyer, which already existed at the time of delivery of the thing and which will occur within two years from the delivery of the goods to the buyer. Within the first six months of the delivery of the thing to the buyer, it is presumed that the defect existed already at the time of delivery of the thing. It is the responsibility of the Online Store to rebut the relevant presumption.
5.2 As the online store sells natural products that usually have a shelf life of less than two years, it is not possible to rely on the non-conformity of the product after the best before the date indicated on the product.
5.3 In the event of a defect, the Buyer has the right to contact the online store within two months at the latest by sending an e-mail to email@example.com or calling the phone: 5081665.
5.4 The online store is not responsible for defects that have occurred after the goods have been handed over to the buyer.
5.5 If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund to the buyer all the fees that resulted from the sales contract.
5.6 The online store will respond to the consumer’s complaint in writing or in a format that can be reproduced in writing within 15 days.
6. Processing of personal data
6.1 The online store uses the personal data entered by the Buyer (including name, phone number, e-mail address, bank details) only for processing the order and sending the goods to the buyer. The online store transfers personal data to companies providing transport services in order to deliver goods.
7. Dispute resolution
7.1 If the buyer has any complaints about the Online Store, they must be sent by e-mail to firstname.lastname@example.org or by calling the 5081665.
7.2 If the buyer and the Online Store are unable to resolve the dispute by agreement, the buyer can turn to the Consumer Disputes Committee. The terms and conditions of the proceedings can be viewed and an application submitted on the website of the Consumer Protection Board. The consumer disputes committee has the competence to resolve disputes arising from the contract concluded between the buyer and the Online Store. The review of the buyer’s complaint by the Commission is free of charge.

8.2 The design, pictures, photos and texts of the website and online store are protected by copyright and the exclusive right to use it belongs to HTM Karolin OÜ. The content of the website may not be reproduced, distributed or altered without the written permission of HTM Karolin OÜ, including blog posts and other materials.
